I'll give you an example....the cops in this state violate the constitution ALL THE TIME....they will get out of their cars and STAND on the side of the road, both sides, and peer into your vehicle as you roll through the stop sign....ostensibly to 'make sure' you are wearing your seatbelts. It is a crime not to wear your seatbelt, you know...gotta protect us fro our own stupidity.
Hoiwever, anything they see, such as a passenger smoking something that even REMOTELY resembles anything that isn't a Marlboro, then you're stopped, really searched, and possibly arrested.
By itself, this is a clear and flagrant violation of the 4th amendment of trhe US constitution....using this illegal act to search you, based on something that MIGHT be going on, is CLEARLY AND PATENTLY illegal. In legal terms, this called 'the fruit of a poisoned tree'...meaning that the very development of probable cause itself was illegal.
As far as what you said about the community feeling the need to reach out and 'help' the drug user, well, when someone FORCES 'help' on you, it ceases to be 'help' and it becomes HURT.
