I'm trying to understand the risks at hand for possessing psilocybe cubenisis (i.e. Magic Mushrooms), and I just want to post my findings as a way to figure out if I'm correct or not. Here I go:
In the state of [UN-NAMED], psilocyben/psilocyn is classified as a schedule 1 hallucinogen.
"Bulk amount" of a controlled substance means any of the following:
"An amount equal to or exceeding thirty grams or ten unit doses of a compound, mixture, preparation, or substance that is or contains any amount of a schedule I hallucinogen other than tetrahydro-cannabinol or lysergic acid amide, or a schedule I stimulant or depressant;"
Felony of 5th degree:
QUANTITY:
The amount of the drug involved is under or at the bulk amount.
PENALTY:
"I couldn't find a penalty"
Felony of the 3rd degree:
QUANTITY:
The amount of the drug involved exceeds the bulk amount but does not exceed five times the bulk amount. (i.e. 30g * 5 = 150g)
PENALTY:
Aggravated possession of drugs is a felony of the third degree, and there is a presumption for a prison term for the offense
--"I stop at this because theres nooo way I'd have more than 150g of dried mushrooms. That's defiantly more than any recreational user should ever have with them."--

Of the 104,400 people who committed drug offences under the MDA in 2000:
41 per cent were given a police caution and not taken to court.
26 per cent were fined.

9 per cent were imprisoned.

I'm not very familiar with law, but lets say I get arrested with 20-30g of dried psilocybe mushrooms. What is the likelihood that I will be sent to jail for 'any' amount of time? Any other consequences that I may be subject to would be helpful as well.
I don't intend on selling, and all of my drug use is for spiritual purposes (except for a little weed now and then). D'you think that this could come into account? Or does my spirituality really have no effect on the law. Any help would be much appreciated.
EDIT: I hear that if you carry it in a powdered form, there's a possibility that they will test it for some other drug, like cocaine and destroy the evidence inadvertently.
